Will Take Photo Engagement Session Giveaway – Terms and Conditions
1. Sponsor
This giveaway is sponsored by Will Take Photo (hereinafter referred to as "Sponsor"), a photography service based in the Bay Area, CA, operating under the website willtakephoto.com and social media handles @willtakephotographs (Instagram) and Will Take Photo (Facebook).
2. Eligibility
The Will Take Photo Engagement Session Giveaway (the "Giveaway") is open to legal residents of the United States who are 18 years of age or older at the time of entry.
Participants must be located in the Bay Area, CA, or willing to travel to the Bay Area for the session at their own expense.
Employees, contractors, or immediate family members of the Sponsor are not eligible to participate.
No purchase is necessary to enter or win. A purchase does not increase the chances of winning.
3. Giveaway Period
The Giveaway will run monthly, starting on the 1st of each month and ending on the last day of the month (11:59 PM PST).
Entries submitted before or after the monthly Giveaway Period will not be eligible.
4. How to Enter
To enter, participants must complete the official entry form provided in the Giveaway advertisement on Instagram (@willtakephotographs) or Facebook (Will Take Photo).
The form requires participants to provide their full name, email address, phone number, and a brief description of their engagement story.
Only one entry per person per month is permitted. Multiple entries from the same person will be disqualified.
By submitting an entry, participants agree to these Terms and Conditions.
5. Winner Selection and Notification
Up to four (4) winners will be selected each month via a random draw from all eligible entries received during the Giveaway Period.
Winners will be notified via email and/or phone within five (5) business days following the end of the monthly Giveaway Period.
If a winner does not respond within seven (7) days of notification, or if they are found to be ineligible, the Sponsor reserves the right to select an alternate winner.
The odds of winning depend on the number of eligible entries received.
6. Prize Details
Each winner will receive one (1) free 1-hour engagement photography session with Will Take Photo in the Bay Area, CA.
The session must be scheduled within 30 days of winner notification, subject to the Sponsor’s availability.
Winners will receive fifteen (15) professionally edited and touched-up digital images as the final deliverable, provided via a digital download link within two (2) weeks of the session.
The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or other services.
Any additional costs (e.g., travel to the session location, props, or wardrobe) are the responsibility of the winner.
7. Rights and Usage
By participating in the Giveaway and accepting the prize, winners grant Will Take Photo the perpetual, non-exclusive right to use, reproduce, and distribute the images from the engagement session for promotional purposes.
This includes, but is not limited to, promoting the Sponsor’s paid photography services, Instagram page (@willtakephotographs), Facebook page (Will Take Photo), website (willtakephoto.com), and other marketing materials.
Winners will be credited where feasible (e.g., tagged on social media posts), but the Sponsor is not obligated to provide credit in all instances.
Winners retain personal use rights to the images but may not sell, license, or distribute them for commercial purposes without the Sponsor’s written consent.
8. Privacy
Personal information collected via the entry form (e.g., name, email, phone number) will be used solely for the purpose of administering the Giveaway, contacting winners, and scheduling the session.
The Sponsor may add participants to their email marketing list but will provide an option to unsubscribe in accordance with applicable privacy laws.
Personal information will not be shared with third parties except as necessary to fulfill the Giveaway (e.g., scheduling tools) or as required by law.
9. General Conditions
The Sponsor reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor beyond the Sponsor’s control impairs the integrity of the Giveaway.
The Sponsor is not responsible for lost, late, incomplete, or misdirected entries, or for any technical issues that prevent participation.
By entering, participants agree to release Meta (Facebook and Instagram), its affiliates, and the Sponsor from any liability related to the Giveaway, including but not limited to injuries, losses, or damages arising from participation or acceptance of the prize.
This Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta (Facebook or Instagram). Participants are providing information to the Sponsor, not to Meta.
10. Compliance with Laws
The Giveaway is subject to all applicable federal, state, and local laws and regulations.
Participants are responsible for any taxes associated with the prize, if applicable.
11. Winner Announcement
The names or social media handles of winners may be announced on the Sponsor’s Instagram (@willtakephotographs) and Facebook (Will Take Photo) pages, unless the winner requests otherwise in writing prior to the announcement.

13. Governing Law
These Terms and Conditions are governed by the laws of the State of California. Any disputes arising from the Giveaway will be resolved in the courts of Santa Clara County, CA.
